LEGAL TERMS AND CONDITIONS OF THE SOUTH SUMMIT MADRID 2027 TICKET GIVEAWAY

1. ORGANIZER

Giveaway organized by SPAIN STARTUP AND INVESTORS SERVICES, S.L. (hereinafter, "South Summit"), with registered address at Paseo de la Castellana No. 70, 1st floor, 28046, Madrid, and Tax ID (C.I.F.) number B86685294.

2. NATURE AND SCOPE OF APPLICATION

This is an occasional giveaway involving no financial consideration whatsoever from participants, and is excluded from the scope of Law 13/2011, of May 27, on the regulation of gambling, as there is no profit motive or financial risk for the participant.

The giveaway is run independently through South Summit's Instagram account to thank the support of our community. It is not associated with, sponsored by, or administered by any third-party platform.

3. DURATION AND PARTICIPATION PERIOD

The participation period will be one week from the publication of the giveaway on social media. Exact dates will be indicated in the social media post itself.

4. ELIGIBILITY AND PARTICIPATION REQUIREMENTS

The following individuals may participate in the giveaway, provided they meet the requirements below:

  • Follow South Summit's official Instagram profile
  • Like the giveaway post
  • Tag another real user of the platform in the comments of said post
  • Be of legal age under the laws of the participant's country of residence.

All of the above requirements must be met to participate. Only one entry per user will be counted, regardless of the number of comments made.

Employees, collaborators, directors, or representatives of SPAIN STARTUP AND INVESTORS SERVICES, S.L., as well as their immediate family members, are excluded from participation.

5. GIVEAWAY MECHANICS

Once the participation period has ended, a random drawing will be held among all users who participated and correctly met the requirements. The random selection process will ensure equal opportunity among all valid participants.

Five (5) winners will be selected, along with a sufficient number of alternates in case a winner withdraws or is unable to accept the prize. The results of the drawing will be final and not subject to appeal.

6. PRIZES

Each of the five (5) winners will receive one (1) "Attendee Ticket" to attend South Summit Madrid 2027, with the general features and benefits described on the official website: https://www.southsummit.io.

The market value of each ticket is €299 (VAT included), for a total prize pool value of €1,495.

Prizes are not redeemable for cash or exchangeable for any other goods or services. Tickets are non-transferable and strictly for personal use. South Summit will not issue any refund if a winner had already purchased a ticket for South Summit Madrid 2027.

Prizes do not include benefits other than the ticket referenced above. Travel expenses, accommodation, meals, or any other costs not covered on the event's official website are expressly excluded.

7. NOTIFICATION OF WINNERS AND PRIZE COLLECTION

Winners will be individually notified via Instagram within a reasonable period following the drawing.

The winner will have five (5) business days from receipt of the notification to accept the prize and provide the information necessary to redeem it, by responding to the direct message received or by writing to South Summit's official Instagram account.

If this period elapses without a response, or in the event of express refusal, the prize will be offered to the designated alternate, who will have the same period to accept it. South Summit reserves the right to declare the prize void if the alternate also fails to accept it within the given timeframe.

South Summit will communicate exclusively from this official account to announce results. We will never request bank details, credit card numbers, or registration via external links in order to deliver the prize.

8. TAX OBLIGATIONS

Prizes obtained in this giveaway may be subject to taxation depending on the tax laws applicable in each winner's country of tax residence.

For winners who are tax residents in Spain, receiving the prize may constitute a capital gain subject to Personal Income Tax (IRPF), in accordance with Law 35/2006, of November 28. Each winner will be solely responsible for complying with their tax obligations arising from receipt of the prize. For informational purposes, the declarable value of the prize is €299 per ticket.

South Summit will comply with any reporting or withholding obligations that may apply under current regulations. Pursuant to Article 75.3.f) of Royal Decree 439/2007, of March 30, approving the Personal Income Tax Regulations, there is no obligation to withhold or make a payment on account for prizes awarded from games whose withholding base does not exceed €300.

Winners are advised to consult a tax advisor regarding the specific tax implications in their country of residence.

9. PERSONAL DATA PROTECTION

9.1 Data Controller

9.2 Purpose and Legal Basis of Processing

Participants' personal data will be processed for the following purposes:

  • Management of participation in the giveaway and verification of participation requirements. Legal basis: performance of the contractual or pre-contractual relationship (Art. 6.1.b GDPR).
  • For winners and alternates: management and delivery of the prize, as well as public announcement of the results. Legal basis: performance of the giveaway terms (Art. 6.1.b GDPR) and the data subject's express consent (Art. 6.1.a GDPR).
  • Compliance with tax obligations arising from the delivery of the prize. Legal basis: compliance with a legal obligation (Art. 6.1.c GDPR).

9.3 Retention Period

Participants' personal data will be retained for as long as necessary to manage the giveaway and, in any case, for the periods legally required under applicable regulations to handle possible claims, the statute of limitations for liabilities arising from the giveaway, and compliance with legal, tax, and commercial obligations. Winners' data may be retained for up to four (4) years for tax purposes and to address possible claims.

9.4 Recipients

Data will not be shared with third parties except where legally required. No international data transfers outside the European Economic Area will be made, unless necessary to comply with legal obligations in the winner's country of residence, in which case appropriate safeguards will be guaranteed in accordance with Chapter V of the GDPR.

9.5 Data Subject Rights

Participants may exercise their rights of access, rectification, erasure, objection, restriction of processing, and data portability by writing to: privacy@spain-startup.com

They also have the right to file a complaint with the Spanish Data Protection Agency (www.aepd.es) if they believe the processing of their data does not comply with the GDPR or the LOPDGDD (Spanish Data Protection Law).

Winners have the right to withdraw their consent at any time, without affecting the lawfulness of processing based on consent prior to its withdrawal. Withdrawing consent before the prize is delivered may result in forfeiture of the prize.

10. IMAGE RIGHTS ASSIGNMENT

Participation in the giveaway does not in itself imply any assignment of image rights.

The giveaway will be public in nature. South Summit reserves the right to disclose and communicate the progress of the giveaway, as well as the identity of the winners, through its digital communication channels and social media profiles for transparency purposes.

11. DISCLAIMER OF LIABILITY

South Summit will not be liable for failures, delays, or technical problems that may hinder or prevent participation in the giveaway, including Instagram outages, connectivity errors, or failures in the technical tools used to select winners.

If the giveaway cannot be held or must be suspended due to force majeure or causes beyond the organization's control, South Summit will announce this through its official channels and provide information on available alternatives.

13. ACCEPTANCE OF THE TERMS AND DATA PROCESSING

Participation in the giveaway is entirely voluntary and necessarily implies knowledge and full acceptance of these legal terms, as well as consent to the processing of the participant's personal data for the purposes described herein.

14. APPLICABLE LAW AND JURISDICTION

This giveaway will be governed by Spanish law. In the event of a dispute, the parties submit to the jurisdiction of the Courts of the city of Madrid, expressly waiving any other jurisdiction that may apply to them.
